In the following, we would like to provide you with detailed information on the personal data (i.e., data concerning personal details such as name, address or IP address) we collect during your visit to our websites, why we collect the data and how long it is stored. In addition, we have listed detailed information on your rights related to the processing of your personal data and how you can assert these rights.

I. Overview of the collected data

We collect different types of data during your visit to our webpages. On the one hand, we collect personal data, i.e. data that you provide voluntarily, for example, by placing an order, signing up to our newsletter or by contacting us. On the other hand, our website uses cookies or pixels that collect information and general data to help us monitor use of our websites. Therefore, this information will be automatically transmitted to us or to third parties when you use our websites.

 

1. Personal data

It is possible to regularly visit our websites without being required to provide any personal data. However, in the cases listed below, you may be required to voluntarily disclose your personal data in order to use our services.

a.) Order placement in our shop

According to our purchase agreement, we can only effectively process order placements in our shop, if you provide the following information: first name, surname, address and e-mail address. Providing your phone number is entirely voluntary. The legal basis for processing your data is Art. 6 Para. 1 Point b) of the General Data Protection Regulation (GDPR).

Your personal data will be stored for as long as necessary to guarantee fulfilment of our contractual obligation. After expiry of this period, they will be stored for the duration as determined by the respective legal retention periods (10 years). Your data will then subsequently be deleted.

b.) Newsletter

You can also sign up to receive our newsletter on our website. The newsletter includes information on current offers and the latest news about our company. You can subscribe to our newsletter by entering your e-mail address.

According to Art. 6 Para. 1 Point a) of the GDPR, we require your explicit consent to process your e-mail address for the purpose described in the paragraph above.

You can unsubscribe from the newsletter at any time by clicking the link provided in each newsletter. You may revoke your consent to receiving our newsletter by other means as well, for example, by sending an e-mail to hello@yoonitbikes.com

If we have received your e-mail address in connection with the purchase of a product or service from our shop, we have the right to e-mail you offers for similar own products without your explicit consent. The legal basis for the processing of your e-mail address in this regard is based on Art. 6 Para. 1 Point f) of the GDPR.

You can object to the processing of your data for advertising purposes at any time.

We will store your data for the purpose of sending the newsletter or for direct advertising purposes as long as you do not revoke your consent or object to receiving the newsletter or the processing of your data for advertising purposes. 

c.) Contact

When you contact us via e-mail or telephone, you are also providing personal information. This personal data will be used in order to process your request (cf. Art. 6 Para. 1 Point b) of the GDPR) or for a period of six months in the case of follow-up queries.

Your data will not be shared with others without your explicit consent, unless necessary to fulfil the contractual obligation. 

2.  During your visit to our website automatically collected data

In addition to the data you provide voluntarily, we also automatically collect data each time you visit our websites. These data are required to improve the seamless performance of this website and, in order to directly provide you with certain information and links to third parties. Please find in the following a detailed description of all programs used on our website, their purpose as well as the different categories of collected data.

Most of the programs on our websites use so-called ‘cookies’ to collect data. Cookies are small text files that are automatically saved by your browser and stored on your device (computer, tablet, smartphone etc.) when you visit our website. Cookies do not damage your device. The purpose of cookies is to make our website more user-friendly and effective. For example, cookies allow us to recognise your browser when you re-visit our website, thereby ensuring that your personal settings from earlier visits remain unchanged. We also use cookies in order to statistically evaluate the use of our website, and to optimise our offers (e.g. Google Analytics). Detailed information about the data we automatically collect when you visit our website is provided in the following:

 

a.) Log files

During your visit to our website, the browser on your device collects and stores information which is automatically sent to our website’s server. The data is only stored temporarily in a so-called server log file.

As part of this process, the following information is automatically collected: IP address, date and time of access, if applicable, name and URL of the accessed file, if applicable, originating website (referrer URL), browser used and, if applicable, your computer’s operating system as well as the name of your access provider.

We process the aforementioned data for administrative purposes, in order to optimise the performance of our website, and to guarantee user-friendliness. Additionally, the data is also processed to ensure our system works safely and securely.

Your IP address, i.e. the only data that could identify you, will be deleted or anonymised immediately so that we will not be able to link you to your activity on our website. The legal basis for data processing is Art. 6 Para. 1 Point 1 of the GDPR.

You can prevent placement of cookies by changing the settings in your browser software. In addition, you can prevent collection of data by the cookie, i.e. data related to your use of our website as well as the processing of this data through Google, by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en).

b.) Google Analytics

For the improvement and further development of our website and services, we use Google Analytics, a web analysis service. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereafter referred to as “Google”). Google uses “cookies” to create pseudonymous user profiles. The information generated by the cookie contains information about your use of our website, such as the browser type/version, the operating system, the previously visited page (referrer URL), the host name of the accessing computer (IP address) and the time of the server request. The information generated by the cookie concerning your use of this website (including IP address) is transmitted and saved to a server at Google in the US. This information may also be transmitted to third parties if required by law or, if third parties process this data on behalf of the company.

Through the activation of IP address anonymisation on this website, your IP address is shortened by Google beforehand in the Member States of the European Union or the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and be shortened there.

Google uses this information in order to evaluate the use of our website, compile reports on website activities for the website operator and to perform other services associated with website and Internet use. Google will also transmit this data to third parties if necessary, insofar as it is required by law or the third parties process this data on behalf of Google. Third parties, including Google, advertise on the Internet. They use the stored cookies to place adverts based on the user’s previous visits to the website.

Google does not combine your IP address with other data. You can prevent cookies being saved to your computer by changing the settings in your browser software. However, if you do so you may not be able to fully use all functions of this website.

Storage of aforementioned data is based on our interest in evaluating the information in order to continuously further develop our website and services, and therefore also on Art. 6 Para. 1 Point f) of the GDPR.

 

II. Your rights

You have the right to request information about your personal data at any time. Furthermore, you also have the right to transfer, rectify or delete as well as restrict any processing of your data. You can also object to the processing of your data at any time. In detail:

1.) According to Art. 15 of the GDPR, you have the right to ask us, whether your personal data will be processed or not. If your data has been processed, you also have the right to request information about this personal data, on the processing purpose, the category of personal data processed, the recipients or categories of recipients to whom the personal data has been or will be disclosed, the intended storage duration of your personal data. Furthermore, you have the right to request correction or deletion of your personal data; the right to restrict processing of your personal data or the right to object to processing of your personal data, the right to appeal to a supervisory authority and, if the personal data was collected from you directly, the right to request all available information concerning the origin of the data.

2.) According to Article 16 of the GDPR, you also have the right to request immediate action regarding the correction or integration of incorrect personal data.

3.) You are entitled, under the conditions of Art. 17 of the GDPR, to request deletion of your personal data, unless the processing of the data is necessary on order to exercise the right to freedom of expression and information, in order to fulfil a legal obligation, for reasons of public interest or in order to assert, exercise or defend legal claims.

4.) Under the conditions of Art. 20 of the GDPR, you have the right to request the restriction of your personal data processing.

5.) According to Art. 20 of the GDPR, you have the right to receive your personal data in a structured, current and machine-readable format and, if the requirements of Art. 20 of the GDPR are met, to forward the data to another responsible party. In this case, you have the right to request direct forwarding of your personal data to the other responsible parties.

6.) According to Art. 21 of the GDPR, if your personal data has been processed due to legitimate interests pursuant to Art. 6 Para. 1 Sentence 1 Point f) of the GDPR, you have the right to object to processing of your personal data, insofar as there are reasonable grounds resulting from your specific situation.

You have the right to object to processing of your personal data for direct marketing purposes at any time and without providing any particular reason.
